ACCEPTANCE OF TERMS

You acknowledge that all intellectual property rights in our Site, Services and the underlying technology, and all information and content available on our Site and through the Services, excluding Your Content are owned by C9 Airwear and our suppliers (including other users). Service Content is protected by international copyright laws. Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicenseable, revocable license to view and use the Service Content for your personal non-commercial purposes. No other use of the Service Content is authorized. USAGE RESTRICTIONS

The Sites and Apps may be accessed and used only by individuals who can form legally binding contracts under applicable laws, who are 18 years of age or older, and who are not barred from using the Sites and Apps under applicable laws.

The Sites and Apps are provided solely as a convenience to you for non-commercial use. You may access and use the Sites and Apps only in accordance with all applicable laws and regulations and with these Terms of Use. You acknowledge and agree that C9, in its sole discretion to reject the registration and debar you from using services of c9airwear.com. You further agree that you will not: (a) resell for commercial purposes products purchased through use of the Sites; (b) resell or make commercial use of the Sites or Apps or Content therein; (c) other than for your use of the Sites and Apps as expressly permitted in these Terms of Use, access or attempt to access any systems or servers on which the Sites and Apps are hosted or modify or alter the Sites and Apps in any way;

Any unauthorized use of the Sites and Apps will terminate the permission or license granted by these Terms of Use, will result in you being barred from use of the Sites and Apps, and may violate applicable law including copyright laws, trademark laws (including trade dress), and communications regulations and statutes.

COLORS

We have made every effort to display the colors of our products that appear on the Website as accurately as possible. However, as the actual colors you see will depend on your monitor, we cannot guarantee that your monitor's display of any color will be accurate.

USER ACCOUNT

In order to purchase products or services through the use of the Sites, you must establish an account with C9. You are solely responsible and liable for all activities, including, without limitation, all purchases of products and services through the use of the Sites that occur under your account or your account password.

You acknowledge and agree that C9 Airwear may access, preserve, and disclose your account information, all communications to and from you, all information relating to your use of the Sites, and all information relating to the use of the Sites under your account or account password if Sangam India Limited is required to do so by law or legal process or if C9 determines, in its sole discretion, that such action is necessary to protect the rights of C9, third parties, and other users of the Sites or for purposes of responding to your request for customer service.

TERMS OF SALE

You consent to receive electronic communications from Sangam India Limited either in the form of email/sms sent to you at the email address/mobile number listed on your account or by communications posted on the Sites and Apps. You acknowledge and agree that any electronic communication in the form of such email/sms or posting on the sites shall satisfy any legal requirement that such communication be in writing.

BUYER'S ARRANGEMENT WITH ISSUING BANK:

All Valid Credit / Debit/ Cash Card/ and other payment instruments are processed using a Credit Card payment gateway or appropriate payment system infrastructure and the same will also be governed by the terms and conditions agreed to between the Buyer and the respective Issuing Bank and payment instrument issuing company.

All Online Bank Transfers from Valid Bank Accounts are processed using the gateway provided by the respective Issuing Bank which supports Payment Facility to provide these services to the Users. All such Online Bank Transfers on Payment Facility are also governed by the terms and conditions agreed to between Buyer and the respective Issuing Bank.

INDEMNITY

You agree to indemnify, defend and hold Company and its officers, directors and employees entirely harmless from and against any and all demands, costs, damages, liabilities, and expenses arising out of any third party claims relating to (i) your use of the Site, (ii) your breach of any of the Terms, or (iii) your violation of any applicable law, regulation or right of any third party.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, YOU AGREE THAT COMPANY SHALL NOT BE LIABLE TO YOU OR ANY THIRD PARTY CLAIMING THROUGH YOU FOR ANY DAMAGES SUFFERED AS A RESULT OF YOUR USE OF THE SITE, INCLUDING PRODUCTS, MATERIALS OR EVENTS REFERENCED THEREBY. GOVERNING LAW

This User Agreement shall be construed in accordance with the applicable laws of India. The Courts at Mumbai shall have exclusive jurisdiction in any proceedings arising out of this agreement.

Any dispute or difference either in interpretation or otherwise, of any terms of this User Agreement between the parties hereto, the same shall be referred to an independent arbitrator who will be appointed by Sangam India Limited. and his decision shall be final and binding on the parties hereto. The above arbitration shall be in accordance with the Arbitration and Conciliation Act, 1996 as amended from time to time. The arbitration shall be held in Mumbai. The High Court of judicature at Mumbai alone shall have the jurisdiction and the Laws of India shall apply.
